YUMMY POINTS® LOYALTY PROGRAM TERMS AND CONDITIONS

The Program is open to all residents of Ontario who have reached the age of majority at the date of enrollment.
Only one Yummy Points® Card is available per customer.
The Yummy Points® Card is not a credit card. The Yummy Points® Card is the property of Yummy Market and it may be revoked at any time by Yummy Market in its sole discretion.
Each Yummy Market Member (sometimes referred to as a “Member”) will be issued a Yummy Points® Card that has a unique number ascribed to it and which is registered in the Member’s name. Yummy Points® Members cannot share their account number and account information with anyone else. Account information should be protected and kept secure.
Yummy Points® Members must advise Yummy Market immediately of any changes of Personal Information (as hereinafter defined) including name, address, telephone numbers and e-mail address by completing a new Yummy Points® Loyalty Program Application Form as per paragraph 1. If Yummy Market believes that some of its records are inaccurate, it may contact the Member to verity its records. Yummy Market reserves the right to cancel any Yummy Points® Card for which it has incomplete or inaccurate Personal Information and all Yummy Points® redemptions on that account may be blocked. The submission of false or fictitious Personal Information will result in all the Yummy Points® accumulated on an account being forfeited.
Yummy Market reserves the right to refuse issuance of a Yummy Points® Card to any customer who does not follow the prescribed enrollment procedures.
Customers participating in the Program must present their personal valid Yummy Points® Card to collect points and earn rewards. Any unauthorized reproduction of the Yummy Points® Card, any failure to comply with any terms and conditions or any violation, fraud or abuse of the Yummy Points® Loyalty Program may result in forfeiture of all points and possible termination of the Member’s account without compensation as deemed appropriate and necessary by Yummy Market.
Collection of Yummy Points®
To collect Yummy Points®, a Member must make eligible purchases using their personal valid Yummy Points® Card. The Member’s personal Yummy Points® Card must be presented to the cashier before the purchase transaction is completed. The original Yummy Points® Card must be presented at the time of purchase, and no facsimile thereof or just the account number will be accepted. In addition, no Yummy Points® will be awarded once the transaction is completed.
Yummy Points will be awarded at the rate of 10 Yummy Points® for each $1.00 spent on each separate purchase. Yummy Points® will be calculated by reference to the net (purchase price less discounts) pre-tax total of each cash register receipt. Any promotional points offered on certain products from time to time shall form part of the Member’s total points balance.
Yummy Points® will not be issued respecting the purchase of the following items/services: Yummy Market electronic gift cards, wireless/phone cards, event tickets, bottle deposits/returns, lottery, the redemption portion of the transaction and any other items specified as exclusions from time to time. Yummy Points® will be awarded when a Yummy Points® Member pays for a purchase with an electronic gift card. Yummy Market reserves the right to add or delete items eligible for Yummy Points® issuance at any time, at its sole discretion, without notice.
All Yummy Points® are shown on the cash register receipt for each purchase when a Yummy Points® Card is presented before the completion of the purchase transaction. In the event that Yummy Points® do not appear on a receipt due to a technical failure, they will be updated on the cash register receipt at a later purchase transaction date. Yummy Points® Members may also inquire about their Yummy Points® balance at the Customer Service Counter.
Returns and/or exchanges will be honoured only if the original cash register receipt is presented at the time of the return and/or exchange together with the Yummy Points® Card. On a return and/or exchange the Yummy Points® will be deducted automatically from the Member’s card number that was used for the original purchase. Upon the return and/or exchange of purchases earned through the redemption of Yummy Points®, the Member’s points balance will be reduced by the equivalent amount of points issued on the original transaction.
All Yummy Points® totals, as shown on the cash register receipts, will be deemed correct unless otherwise substantiated by the Member by bringing forward evidence satisfactory to Yummy Market in its sole discretion. Discrepancies must be addressed with the Customer Service Counter within 3 months of the date on which the discrepancy occurred. Yummy Market reserves the right to restrict redemption or put a “hold” on Yummy Points® for up to 45 days from the date the points are posted to an account.
Yummy Points® are not transferable from one Member to another and are reduced to zero upon closure of a Yummy Points® membership.
Should any Yummy Points® Member not acquire Yummy Points® for 12 consecutive calendar months, the membership will be deemed to be inactive and all accumulated Yummy Points® will be forfeited. At that time the Yummy Points® balance may be reduced to zero at Yummy Market’s sole discretion.
Redemption of Points
Yummy Points® may be redeemed subject to our terms and conditions on subsequent purchases consisting of a predetermined discount of $1.00 for every 1000 points redeemed up to the amount of the pre-tax purchase. All unredeemed points may be redeemed in the future in the same way.
Yummy Market reserves the right to change the conversion rate for Yummy Points® at any time by posting 30 days’ notice of its intention to do so in its stores and/or on its website. Yummy Market reserves the right to change or discontinue the Yummy Points® Loyalty Program at any time, without advance notice. In the event of discontinuing the Yummy Points® Loyalty Program, Yummy Market will attempt to provide at least thirty (30) days’ notice to you, within which you may redeem any outstanding Yummy Points®.
In accordance with Federal legislation, HST and all applicable taxes are calculated and payable by the Member on the full amount of the purchase price before any reduction for redeemed rewards.
In case of a lost Yummy Points® Card, upon presentation of proper identification, a new Member number will be provided to the Member at the Customer Service Counter. The accumulated unredeemed Yummy Points® balance shall remain intact. If a lost Yummy Points® Card is found and used by any other person, all Points relating to purchases made by such other person will be credited to Yummy Points® Member’s account. Yummy Market assumes no liability or responsibility for Yummy Points® redeemed by any person(s) prior to the notification to the Customer Service Department that the Card is lost. Any Yummy Points® redeemed prior to notification shall be at the Member’s risk. Yummy Market is not responsible for any errors or omissions with regard to the Yummy Points® Loyalty Program. Yummy Market is also not responsible for any lost or unauthorized use of Yummy Points® or for any redemption of Yummy Points® in the Yummy Points® Loyalty Program.
Yummy Market will not be liable or responsible in any manner for any tax consequences which may flow from any participation in the Yummy Points® Loyalty Program.
Yummy Points® have no cash value and are not exchangeable for cash. Yummy Points® cannot be assigned, exchanged, purchased or given by gift.
Yummy Market Personal Information Protection Policy
Yummy Market will not give, rent or sell its Yummy Points® Member lists to any organization or individual. Yummy Market will allow limited and secured access to customer information by authorized entities under its strict supervision solely for the purposes of assisting Yummy Market in processing customer information. Access to this information will be restricted to authorized personnel of Yummy Market.

Yummy Points Program
At Yummy Market Inc., we are committed to providing our customers and Yummy Points® Loyalty Program members (hereinafter “members”) with exceptional service. As providing this service involves the collection, use and disclosure of some personal information about our members, protecting their personal information is one of our highest priorities.
While we have always respected our members’ privacy and safeguarded their personal information, we have strengthened our commitment to protecting personal information as a result of Ontario’s Personal Information Protection and Electronic Documents Act (PIPEDA). PIPEDA sets out the ground rules for how Ontario businesses may collect, use and disclose personal information.
We will inform our members of why and how we collect, use and disclose their personal information, obtain their consent where required, and only handle their personal information in a manner that a reasonable person would consider appropriate in the circumstances.
This Personal Information Protection Policy, in compliance with PIPEDA, outlines the principles and practices we will follow in protecting members’ personal information. Our privacy commitment includes ensuring the accuracy, confidentiality, and security of our members’ personal information and allowing our members to request access to, and correction of, their personal information.
Personal Information – means information about an identifiable individual, such as but not necessarily limited to their name, age, home address and phone number, social insurance number, income, etc.. Personal information does not include contact information (described below).
Contact information – means information that would enable an individual to be contacted at a place of business and includes name, position name or title, business telephone number, business address, business email or business fax number. Contact information is not covered by this policy or PIPEDA.
Privacy Officer – means the individual designated responsibility for ensuring that Yummy Market Inc. complies with this policy and PIPEDA.
Policy 1 – Collecting Personal Information
1.1 Unless the purposes for collecting personal information are obvious and the member voluntarily provides his or her personal information for those purposes, we will communicate the purposes for which personal information is being collected, either orally or in writing, before or at the time of collection.
1.2 We will only collect member information that is necessary to fulfill the following purposes:
2.1 We will obtain member consent to collect, use or disclose personal information (except where, as noted below, we are authorized to do so without consent).
2.2 Consent can be provided orally, in writing, or electronically or it can be implied where the purpose for collecting using or disclosing the personal information would be considered obvious and the member voluntarily provides personal information for that purpose.
2.3 Consent may also be implied where a member is given notice and a reasonable opportunity to opt-out of his or her personal information being used for mail-outs, the marketing of new services or products, and the member does not opt-out.
2.4 Subject to certain exceptions (e.g., the personal information is necessary to provide the service or product, or the withdrawal of consent would frustrate the performance of a legal obligation), members can withhold or withdraw their consent for Yummy Market Inc. to use their personal information in certain ways. A member’s decision to withhold or withdraw their consent to certain uses of personal information may restrict our ability to provide a particular service or product. If so, we will explain the situation to assist the member in making the decision.
2.5 We may collect, use or disclose personal information without the member’s knowledge or consent in the following limited circumstances:
Policy 3 – Using and Disclosing Personal Information
3.1 We will only use or disclose member personal information where necessary to fulfill the purposes identified at the time of collection or for a purpose reasonably related to those purposes such as:
3.2 We will not use or disclose member personal information for any additional purpose unless we obtain consent to do so.
3.3 We will not sell member lists or personal information to other parties unless we have consent to do so.
Policy 4 – Retaining Personal Information
4.1 If we use member personal information to make a decision that directly affects the member, we will retain that personal information for at least one year so that the member has a reasonable opportunity to request access to it.
4.2 Subject to policy 4.1, we will retain member personal information only as long as necessary to fulfill the identified purposes or a legal or business purpose.
Policy 5 – Ensuring Accuracy of Personal Information
5.1 We will make reasonable efforts to ensure that member personal information is accurate and complete where it may be used to make a decision about the member or disclosed to another organization.
5.2 Members may request correction to their personal information in order to ensure its accuracy and completeness. A request to correct personal information must be made in writing and provide sufficient detail to identify the personal information and the correction being sought.
5.3 If the personal information is demonstrated to be inaccurate or incomplete, we will correct the information as required and send the corrected information to any organization to which we disclosed the personal information in the previous year. If the correction is not made, we will note the members’ correction request in the file.
Policy 6 – Securing Personal Information
6.1 We are committed to ensuring the security of member personal information in order to protect it from unauthorized access, collection, use, disclosure, copying, modification or disposal or similar risks.
6.2 Appropriate security measures will be followed to ensure that member personal information is appropriately protected.
6.3 We will use appropriate security measures when destroying member’s personal information.
6.4 We will continually review and update our security policies and controls as technology changes to ensure ongoing personal information security.
Policy 7 – Providing Members Access to Personal Information
7.1 Members have a right to access their personal information, subject to limited exceptions as identified in PIPEDA.
7.2 A request to access personal information must be made in writing and provide sufficient detail to identify the personal information being sought.
7.3 Upon request, we will also tell members how we use their personal information and to whom it has been disclosed if applicable.
7.4 We will make the requested information available within 30 business days, or provide written notice of an extension where additional time is required to fulfill the request.
7.5 A minimal fee may be charged for providing access to personal information. Where a fee may apply, we will inform the member of the cost and request further direction from the member on whether or not we should proceed with the request.
7.6 If a request is refused in full or in part, we will notify the member in writing, providing the reasons for refusal and the recourse available to the member.
Policy 8 – Questions and Complaints: The Role of the Privacy Officer or designated individual
8.1 The Privacy Officer is responsible for ensuring Yummy Market Inc.’s compliance with this policy and PIPEDA.
8.2 Members should direct any complaints, concerns or questions regarding Yummy Market Inc.’s compliance in writing to the Privacy Officer. If the Privacy Officer is unable to resolve the concern, the member may also write to the Information and Privacy Commissioner of Ontario.
